How Smash Factor collects, uses and protects your information, and the acceptable use of this website and the systems behind it.

Online Privacy Policy

Smash Factor LLC values its users' privacy. This Privacy Policy ("Policy") will help you understand how we collect and use personal information from those who visit our website [www.smashfactorlounge.com](https://www.smashfactorlounge.com/) or make use of our online facilities and services, and what we will and will not do with the information we collect. Our Policy has been designed and created to ensure those affiliated with Smash Factor LLC of our commitment and realization of our obligation to meet applicable privacy standards, including the California Consumer Privacy Act, as amended by the California Privacy Rights Act (together, the "CCPA"). We reserve the right to make changes to this Policy at any given time. If you want to make sure that you are up to date with the latest changes, we advise you to frequently visit this page. If at any point in time Smash Factor LLC decides to make use of any personally identifiable information on file, in a manner vastly different from that which was stated when this information was initially collected, the user or users shall be promptly notified by email. Users at that time shall have the option as to whether to permit the use of their information in this separate manner.

This Policy applies to Smash Factor LLC and its affiliates (together, "Smash Factor," "we," "us," or "our"), and it governs any and all data collection and usage by us through www.smashfactorlounge.com. Through the use of www.smashfactorlounge.com, you are therefore consenting to the data collection procedures expressed in this Policy. Some Smash Factor Lounge locations may be independently owned and operated by franchisees, who may maintain their own privacy practices for information they collect directly. Please note that this Policy does not govern the collection and use of information by companies that Smash Factor LLC does not control, nor by individuals not employed or managed by us. If you visit a website that we mention or link to, be sure to review its privacy policy before providing the site with information. It is highly recommended and suggested that you review the privacy policies and statements of any website you choose to use or frequent to better understand the way in which websites garner, make use of and share the information collected.

Specifically, this Policy will inform you of the following:

  1. What personally identifiable information is collected from you through our website, including through cookies and similar technologies;
  2. Why we collect personally identifiable information, the legal basis for such collection, and how long we keep it;
  3. How we use the collected information and with whom it may be shared, including for analytics and advertising;

Information We Collect

It is always up to you whether to disclose personally identifiable information to us, although if you elect not to do so, we reserve the right not to register you as a user or provide you with any products or services. This website collects the following types of information:

This may include your name, address, email address, phone number, membership and booking details, billing and/or payment card information, and anything you send us through surveys, membership forms, contact forms, or email. We use this information when you purchase products and/or services and to deliver the services you have requested.
  • Information collected automatically. When you visit our website, we and our partners automatically collect information through cookies, pixels, and similar technologies, and through server logs. This may include your IP address, approximate location derived from your IP address, browser and device type, operating system, the pages you visit, how long you stay, the website that referred you, and actions you take on the site, such as starting or completing a booking and the dollar value of that booking.
  • Information from third parties. We may receive information from our advertising and analytics partners, such as reports on how our ads perform, and from social media platforms when you interact with our pages on those platforms.

Smash Factor may also use aggregated or de-identified information, such as general age ranges or visitor trends, that cannot reasonably be used to identify you, to help us provide and maintain superior quality service. It is the intent of this site to use personal information only for the purpose for which it was requested, and any additional uses specifically provided for in this Policy.

Cookies, Analytics and Advertising Technologies

Our website uses the following technologies, some of which are provided by third parties:

  • Essential cookies. These are necessary for the website to function, such as keeping the site secure, remembering your cookie choices, and processing bookings. They are always on and cannot be switched off through our cookie banner.
  • Google Analytics. We use Google Analytics, a service provided by Google LLC, to measure visits to our website and understand how people use it. Google collects information such as the pages you visit, your device and browser type, and your approximate location. You can learn more about how Google uses this information at https://policies.google.com/technologies/partner-sites.
  • Meta Pixel. We use the Meta Pixel, provided by Meta Platforms, Inc., to understand visits to our website, measure the effectiveness of our advertising, and show you Smash Factor ads on Facebook and Instagram after you visit our site (known as "retargeting"). The Meta Pixel reports the pages you visit and actions you take on our site, including booking purchases and their dollar value, to Meta. Meta may combine this information with other information it has about you under its own privacy policy, available at https://www.facebook.com/privacy/policy.

Your cookie choices. When you first visit our website, a cookie banner allows you to opt out of non-essential cookies in one click, or to choose which categories of cookies to allow by selecting "Manage Cookie Preferences." You can change your choices at any time by reopening "Manage Cookie Preferences" from our website. You may also be able to block or delete cookies through your browser settings, although parts of our website may not work properly if you do.

Global Privacy Control and Do Not Track. Our website automatically recognizes and honors the Global Privacy Control ("GPC") signal as a valid request to opt out of the sale or sharing of your personal information for the browser or device sending the signal. Because there is not yet a common industry standard for "Do Not Track" browser signals, our website does not respond to Do Not Track signals; please use GPC or our cookie preferences instead.

Why We Collect Information

We are collecting your data for several reasons:

  • To better understand your needs and provide you with the services you have requested, including processing bookings, memberships, and payments;
  • To fulfill our legitimate interest in improving our services and products;

How Long We Keep Information

The length of time we retain said information will be determined based upon the following criteria: the length of time your personal information remains relevant; the length of time it is reasonable to keep records to demonstrate that we have fulfilled our duties and obligations; any limitation periods within which claims might be made; any retention periods prescribed by law or recommended by regulators, professional bodies or associations; the type of contract we have with you, the existence of your consent, and our legitimate interest in keeping such information as stated in this Policy. Use of Information Collected

Smash Factor LLC does not sell your personal information for money, and we do not rent or lease our customer lists and/or names to any third parties. However, as described above, we allow Google and Meta to collect information through cookies and pixels on our website for analytics and advertising. Under California law, this may be considered a "sale" or "sharing" of personal information, even though no money is exchanged. You may opt out at any time, as explained in the "Your California Privacy Rights" section below.

Smash Factor LLC may collect and may make use of personal information to assist in the operation of our website and to ensure delivery of the services you need and request. At times, we may find it necessary to use personally identifiable information as a means to keep you informed of other possible products and/or services that may be available to you from www.smashfactorlounge.com. Smash Factor LLC may also be in contact with you with regards to completing surveys and/or research questionnaires related to your opinion of current or potential future services that may be offered. Smash Factor LLC uses various third-party social media features including but not limited to Facebook, LinkedIn, TikTok, Instagram and other interactive programs. These may collect your IP address and require cookies to work properly. These services are governed by the privacy policies of the providers and are not within Smash Factor LLC's control.

Disclosure of Information

Smash Factor LLC may not use or disclose the information provided by you except under the following circumstances:

  • as necessary to provide services or products you have ordered;
  • to service providers that perform services on our behalf, such as website hosting, booking, payment processing, and email delivery, who are contractually required to use your information only to provide those services to us;
  • to our analytics and advertising partners, Google and Meta, through cookies and pixels on our website as described in this Policy, unless you opt out;
  • in other ways described in this Policy or to which you have otherwise consented;
  • in the aggregate with other information in such a way so that your identity cannot reasonably be determined;
  • as required by law, or in response to a subpoena or search warrant;
  • to outside auditors who have agreed to keep the information confidential;
  • in connection with a merger, acquisition, financing, or sale of all or part of our business, in which case the information will remain subject to the commitments in this Policy;
  • as necessary to enforce the Terms of Service; and
  • as necessary to maintain, safeguard and preserve all the rights and property of Smash Factor LLC.

If you are a California resident, the CCPA gives you the rights described in this section. This section also serves as our notice at collection for California residents.

Your Rights

  • Right to know. You may request that we tell you what personal information we have collected about you, the categories of sources, why we collected it, the categories of third parties we disclose it to, and the specific pieces of personal information we hold about you.
  • Right to delete. You may request that we delete personal information we collected from you, subject to certain exceptions permitted by law, such as completing a transaction or meeting a legal obligation.
  • Right to correct. You may request that we correct inaccurate personal information we hold about you.
  • Right to opt out of sale or sharing. You may direct us not to sell or share your personal information for cross-context behavioral advertising.
  • Right to non-discrimination. We will not deny you services, charge you different prices, or provide you a different level of service because you exercised any of these rights.

How to Opt Out of the Sale or Sharing of Your Personal Information

You may opt out in any of the following ways:

  • Click the "Do Not Sell or Share My Personal Information" link in the footer of any page of our website;
  • Select "Manage Cookie Preferences" on our website and turn off advertising and analytics cookies; or
  • Turn on the Global Privacy Control setting in a browser or browser extension that supports it. We will treat the signal as an opt-out request for that browser or device.

Because opt-outs made through cookies and browser signals are stored on your browser, you may need to opt out again if you clear your cookies or use a different browser or device.

How to Submit a Request to Know, Delete, or Correct

You may submit a request by emailing us at info@smashfactorlounge.com or calling us at (909) 270-3628. To protect your information, we will verify your identity before completing a request to know, delete, or correct, usually by matching information you provide with information we already have. You may use an authorized agent to submit a request on your behalf; we may require proof that the agent is authorized and may ask you to verify your identity directly with us. We will confirm receipt of your request within 10 business days and respond within 45 calendar days, or let you know if we need more time as permitted by law.

California "Shine the Light"

California Civil Code Section 1798.83 permits California residents to request information about our disclosure of personal information to third parties for their direct marketing purposes. Security of Your Information

We use reasonable administrative, technical, and physical safeguards designed to protect the personal information we collect from unauthorized access, use, or disclosure, including encrypted (HTTPS) connections to our website and limiting access to personal information to those who need it. Payment information is processed by our third-party payment processor. No method of transmission over the internet or electronic storage is completely secure, so we cannot guarantee absolute security.

Non-Marketing Purposes

Smash Factor LLC greatly respects your privacy. We do maintain and reserve the right to contact you if needed for nonmarketing purposes (such as bug alerts, security breaches, account issues, and/or changes in Smash Factor LLC products and services). In certain circumstances, we may use our website, newspapers, or other public means to post a notice.

Children Under the Age of 13

Smash Factor LLC's website is not directed to, and does not knowingly collect personal identifiable information from, children under the age of thirteen. If it is determined that such information has been inadvertently collected on anyone under the age of thirteen, we shall immediately take the necessary steps to ensure that such information is deleted from our system's database, or in the alternative, that verifiable parental consent is obtained for the use and storage of such information. Anyone under the age of thirteen must seek and obtain parent or guardian permission to use this website.

Unsubscribe or Opt-Out

All users and visitors to our website have the option to discontinue receiving communications from us by way of email or newsletters. To discontinue or unsubscribe, please use the unsubscribe link in any of our emails or send an email that you wish to unsubscribe to info@smashfactorlounge.com. Unsubscribing from emails does not opt you out of the sale or sharing of your personal information through cookies; to do that, follow the steps in the "Your California Privacy Rights" section above. If you wish to unsubscribe or opt-out from any third-party websites, you must go to that specific website to unsubscribe or opt-out. Smash Factor LLC will continue to adhere to this Policy with respect to any personal information previously collected.

Our website does contain links to affiliate and other websites. Smash Factor LLC does not claim nor accept responsibility for any privacy policies, practices and/or procedures of other such websites. Therefore, we encourage all users and visitors to be aware when they leave our website and to read the privacy statements of every website that collects personally identifiable information. This Privacy Policy Agreement applies only and solely to the information collected by our website.

Changes to This Policy

We review this Policy at least once every 12 months and may update it at any time. When we make changes, we will revise the "Last Updated" date at the top of this Policy. If we make material changes to how we use personal information, we will notify you as described above.

Acceptance of Terms

By using this website, you are hereby accepting the terms and conditions stipulated within the Privacy Policy Agreement. Acceptable Website Use and Data Policy

1. Overview

Smash Factor LLC is committed to protecting Smash Factor LLC's clients (whether actual or potential), employees and the company from illegal or damaging actions by individuals, either knowingly or unknowingly. Internet/Intranet/Extranet-related systems, including but not limited to, the company’s name, website domain address, email, computer equipment, mobile devices, software, operating systems, storage media, network accounts providing electronic mail, WWW browsing, and FTP, are the property of Smash Factor LLC. These systems are to be used for business purposes in serving the interests of the company, and of our clients and customers during normal operations.

2. Purpose

The purpose of this policy is to outline the acceptable use of the company’s name and website domain address, email, computer equipment and other electronic devices at Smash Factor LLC. These rules are in place to protect the clients (whether actual or potential), employees and Smash Factor LLC. Inappropriate use exposes Smash Factor LLC to cyber risks including virus attacks including ransomware, compromise of network systems and services, data breach, and legal issues.

3. Scope

This policy applies to the use of the company’s name and website domain address, email, company information, electronic and computing devices, and network resources to conduct Smash Factor LLC business or interact with internal networks and business systems, whether owned or leased by Smash Factor LLC. All clients (whether actual or potential), employees, contractors, consultants, temporary, and other workers at Smash Factor LLC are responsible for exercising good judgment regarding appropriate use of information, electronic devices, and network resources in accordance with Smash Factor LLC policies and standards, and local laws and regulation. Exceptions to this policy are documented in section 5.2 This policy applies to clients (whether actual or potential), employees, contractors, consultants, temporaries, and other workers at Smash Factor LLC, including all personnel affiliated with third parties.

4. Policy

4.1 General Use and Ownership

  1. Smash Factor LLC proprietary information published on the company’s website, and/or stored on electronic and computing devices whether owned or leased by Smash Factor LLC, the client, employee or a third party, remains the sole property of Smash Factor LLC.
  2. For security and network maintenance purposes, authorized individuals within Smash Factor LLC may monitor website activity, equipment, systems, and network traffic at any time.
  3. Smash Factor LLC reserves the right to audit its website, networks and systems on a periodic basis to ensure compliance with this policy.

4.2 Unacceptable Use

The following activities are, in general, prohibited. Under no circumstances is an clients (whether actual or potential) or employee of Smash Factor LLC authorized to engage in any activity that is illegal under local, state, federal or international law while utilizing Smash Factor LLC-owned resources. The lists below are by no means exhaustive but attempt to provide a framework for activities which fall into the category of unacceptable use.

System and Network Activities

The following activities are strictly prohibited, with no exceptions:

  1. Violations of the rights of any person or company protected by copyright, trade secret, patent or other intellectual property, or similar laws or regulations, including, but not limited to, the installation or distribution of "pirated" or other software products that are not appropriately licensed for use by Smash Factor LLC.
  2. Unauthorized copying of copyrighted material including, but not limited to, digitization and distribution of photographs from magazines, books or other copyrighted sources, copyrighted music, and the installation of any copyrighted software for which Smash Factor LLC or the end user does not have an active license is strictly prohibited.
  3. Accessing data, a server, or an account for any purpose other than conducting Smash Factor LLC business, even if you have authorized access, is prohibited.
  4. Exporting software, technical information, encryption software or technology, in violation of international or regional export control laws, is illegal. The appropriate management should be consulted prior to export of any material that is in question.
  5. Introduction of malicious programs into the network or server (e.g., viruses, worms, trojan horses, ransomware, etc.).
  6. Revealing account password/passphrase to others or allowing use of your account by others.
  7. Making fraudulent offers of products, items, or services originating from any Smash Factor LLC account.
  8. Effecting security breaches or disruptions of network communication. Security breaches include, but are not limited to, accessing data of which the employee is not an intended recipient or logging into a server or account that the employee is not expressly authorized to access, unless these duties are within the scope of regular duties. For purposes of this section, "disruption" includes, but is not limited to, network sniffing, ping floods, packet spoofing, denial of service, brute-forcing accounts, and forged routing information for malicious purposes.
  9. Port scanning or security scanning is expressly prohibited.
  10. Circumventing user authentication or security of any host, network, or account.
  11. Interfering with or denying service to any user other of Smash Factor LLC’s network and website (for example, denial of service attack).
